STANDARD ACCOMMODATION TERMS AND CONDITIONS

1. BOOKING
1.1 When booking online, the rate offered is not guaranteed until you receive written confirmation from the resort. Our technology is robust, however not infallible. Any obvious mistakes will be rectified, and a new quote issued to you.

1.2 We offer flexible, advance purchase and non-flexible rates. Special conditions are attributed to festive bookings for stays between 21 December and 1 January. All are subject to change. No quotes will be guaranteed until a deposit or full payment is made.

1.2.1 Flexible rates: A deposit of 20% of the total booking value is required to confirm your reservation at the time of booking. The remaining balance of a flexible rate is payable 14 days prior to arrival. Please see cancellation terms under section 2.

1.2.2 Advance purchase rates: Full payment of the total booking value is required to confirm your reservation at the time of booking. Please see cancellation terms under section 2.

1.2.3 Non-flexible rates: Full payment of the total booking value is required to confirm your reservation at the time of booking. Non-flexible rates are non-amendable and non-refundable. 

1.2.4 Festive stays between 23 Dec and 01 Jan will be charged a non-refundable deposit of 20% to secure the booking and a non-refundable payment of the final balance is due by 01 Nov. We strongly recommend guests take private holiday insurance.

1.2.5 Package stays: Full payment of the total booking value is required to confirm your reservation at the time of booking. Advance rate bookings can be amended to a new date in future, up to 14 days prior to arrival. Within 14 days of arrival, the booking is non-amendable and non-refundable. Where advance rate booking dates are amended, there may be a supplement payable if the rate is higher for the new booking dates. Some packages are unavailable on certain dates.

1.2.6 Wellness Break Stays: A deposit of 20% of the total booking value is required to confirm your reservation at the time of booking. This deposit is non-refundable and non-transferable. The remaining balance for Wellness Breaks is payable 14 days prior to arrival. This payment is non-refundable. 


1.3 Any special offers cannot be used in conjunction with any other offer, and if conditions are not fully met, then the daily tariff will apply.

1.4 Reservations can only be made by adults aged 18 years old or over. If you arrive at the resort and are under 18 years of age, you will not be permitted to stay alone. We may require photo ID such as Passport or Photo Driving Licence as proof of age.

1.5 We endeavour to ensure your stay is relaxing and enjoyable; please do let us know in advance of your arrival if you have any special requests, dietary requirements or a medical condition. Guests with limited mobility are advised to discuss requirements before arrival.

1.6 For accommodation packages where dinner is included, in the event that you do not make arrangement before your arrival, a table will be reserved for you.

1.7 For accommodation packages where spa treatments are included, in the event that you do not make arrangements before your arrival, a treatment time will be reserved for you.

1.8 Smoking is prohibited in all areas inside the resort, including balconies and terraces. A designated smoking area is provided within the resort grounds. Guests who choose to smoke in our rooms will be charged the full tariff rate for accommodation in the event that we are unable to subsequently let the room.

2. CANCELLATIONS AND PAYMENTS
Like an airline ticket, theatre ticket or overseas holiday, our breaks and stays are a perishable product and therefore, once a booking has been taken, we need to apply firm terms and conditions regarding cancellation or curtailment. We strongly recommend guests take private holiday insurance.

2.1 Cancellations must be received in writing. Without written notice of cancellation, the full amount will be charged.

2.2 Cancellations for reservations are as follows:

2.2.1 Flexible rate 14 days or more prior to arrival: Bookings can be amended or moved free of charge. If cancelling, your deposit will be forfeited.

2.2.2 Flexible rate cancellations less than 14 days prior to arrival: The full sum is non-refundable and non-transferable.

2.2.3 Advance purchase rate cancellations: the full sum is non-refundable and non-transferable.

2.2.4 Non-flexible rate reservations: The full sum is non-refundable and non-transferable.

2.2.5 Retreat Stays less than 6 weeks prior to arrival: the full sum is non-refundable and non-amendable.

2.3 Your accommodation tariff is inclusive of VAT.

2.4 Any outstanding accommodation must be paid before arrival.

2.5 Pre-authorisation – we reserve the right to request that guests provide a valid credit or debit card upon arrival. The Resort may ‘pre-authorise’ your card to allow you to charge additional services to your room. Funds are then released upon check out and can take up to 5 days to be credited back. If you have any concerns regarding this, please do contact us.

2.6 All guests are required to check out with reception before departing.

2.7 Any charges not settled during your stay will be charged to you within 7 days of your departure.

2.8 Accounts can be settled by Mastercard, Visa, Visa Debit, and Amex. Cash is not accepted.

2.9 Admin fees for cancellations may apply.

2.10 Gift vouchers used to redeem your booking must be presented at check in. Failure to do so will result in the full value of the booking being charged on arrival.

3. ARRIVAL & DEPARTURE
3.1 Rooms are available from 3.30pm on your day of arrival. Guests are of course welcome to use the resort facilities and car park if arriving early or staying on later. Please advise us if you require an early check-in.

3.2 Check out time is 11am on the day of departure. Please advise us if you require a late check out.

3.3 All room keys must be returned to reception on checkout. If you fail to do so, we may charge you for a replacement key or lock as required. In the event that a key is not returned after checkout, we request customers to contact the resort to arrange for keys to be returned.

3.4 The safety and wellbeing of all children is solely the responsibility of the parents/guardians. Travel cots may be provided and will be placed within the parent/guardian’s room upon request.

3.5 You must take all reasonable precautions to avoid damage or interference with any items belonging to the resort. Customers are requested to bring any damage to our resort or property to our immediate attention, howsoever caused. We shall contact you after your stay to recover the costs for any repair, replacement or specialist cleaning we incur if you have damaged the resort or its property.

3.6 All tariffs include the use of our Health Club facilities. Guests use the facilities at their own risk, the Resort does not accept any liability in the event of loss or damage to personal property or any acts of negligence resulting in medical assistance being required.

3.7 For guests not staying on a spa-treatment inclusive package, treatments are available but charges will apply and treatments are subject to availability.

4. DOGS IN THE RESORT

4.1 We welcome well-behaved dogs and have a number of dog-friendly bedrooms. Dogs are permitted in some public areas, with the exception of guide dogs who are allowed in all public areas.

4.2 Dogs are welcome in certain guest rooms and a surcharge of £20 per dog, per night will be made.

4.3 All dogs staying within the resort are required to have undergone veterinary flea treatment two-weeks prior to your stay, to ensure all of our rooms remain clean and tidy after your departure.

4.3.2 You must take all reasonable precautions to avoid introducing fleas to our resort. Customers are requested to bring any issues regarding this to our immediate attention. We may contact you after your stay to recover the costs for any replacement or specialist cleaning we incur from flea or ulterior damage incurred by your dog to the resort or its property.

4.4 Within the public areas they are welcome to accompany their owners in the gardens, bar, lounge and Locker, where you may dine with your dog.

4.5 Dogs are not permitted in any other public area.

4.6 Dogs may be left within your guest room while you enjoy St Michaels facilities on site, as long as they are not disturbing other guests.

4.7 Dogs are not permitted to be left in your room while you are off the resort premises.

5. DESCRIPTION
5.1 Whilst St Michaels Resort makes every effort to ensure the accuracy of our property descriptions, they are inevitably subjective and are for guidance only. If there are points of particular importance, please contact St Michaels Resort to clarify information.

5.2 Whilst St Michaels Resort has taken all reasonable steps to ensure that the information contained in its brochures, websites, tariffs, leaflets, advertisements and any other form of promotional material are accurate, St Michaels Resort reserves the right to alter, substitute or withdraw any service, facility or amenity.

5.3 If, in the interest of Health & Safety, a facility has to close, St Michaels Resort will endeavour to re-open it as soon as possible.

6. LIABILITY

6.1 St Michaels Resort cannot accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property and its plumbing, gas, electrical or otherwise, or exceptional weather.

6.2 The Resort cannot be held responsible for articles of value, other than those deposited with Reception for safe custody in the Resort safe, for which a receipt will be given and must be retained by the customer.

6.3 No responsibility is accepted for loss or damage of property, vehicles or vehicle contents belonging to any member of the party during the occupancy. Subject to the remainder of this clause, you should use your own insurance policies to claim the full amount of the loss or damage to your property prior to approaching or pursuing St Michaels Resort. We are, in certain circumstances set out in the Hotel Proprietors’ Act 1956 (Act), liable for loss or damage to your property. However, in those circumstances, we are only liable up to the maximum sums under the Act. In all other circumstances, our total liability shall not exceed twice the daily rate charged for your Booking. If your Booking includes a number of different daily rates, the average rate will be used. St Michaels Resort aims to provide a safe and secure environment for the duration of your stay and where necessary, will take appropriate security measures. If an incident occurs during your stay, resulting in the theft, loss or damage of your property, we will carry out an internal investigation. If we do not feel that your property was stolen, lost or damaged through any fault of ours, our staff or agents, this will be evidence that it was not our fault. In those circumstances, our liability is limited to the maximums under the Act. If an incident is referred to the Police authorities, and they draw the same conclusion as us, this will also be evidence that our liability is limited to those maximums. We shall not be liable, in any circumstances, for any loss or damage to vehicles you bring to the resort or any property left in them. Neither shall we be liable for any loss of profit, or any indirect or consequential loss arising under or in connection with your Booking. Where we are liable, we will only be responsible for losses that are a foreseeable result of a breach or negligence, but not otherwise. The loss or damage will be foreseeable if it is an obvious consequence of the breach or is contemplated by both parties at the time of entering into the contract. Nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; or fraud or fraudulent misrepresentation; or any other form of limitation or exclusion prohibited by law or statute.

6.4 If due to reasons beyond the control of St Michaels Resort, the accommodation is not available whatsoever, St Michaels Resort will refund your payment or book you into an equivalent hotel, but St Michaels Resort will be under no further liability towards you. Events beyond our reasonable control include, but are not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, interruption or fire (except by way of our default) or failure of (except by way of our default) electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.

6.5 Failure to comply with any of the booking conditions may result in the party being asked to leave immediately.

6.6 The resort reserves the right to refuse any bookings.

6.7 Statutory Rights: We have tried to ensure that any rights that you as a consumer have that are implied by law into a contract of this type (statutory rights) are not excluded or limited in any way. If any of these terms conflict with a statutory right or the law changes and your statutory rights change, then the statutory rights will prevail over these terms.

6.8 Third Party Rights: A party that is not a party to our Contract shall have no right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.

6.9 The laws of England and Wales govern these terms.

6.10 We reserve the right to change these terms from time to time. The terms applicable to your Booking are those in force on the date of Booking (or amendment, as applicable).

6.11 St Michaels Resort reserves the right to charge the guest for both accidental and criminal damage to facilities and property owned or managed by St Michaels Resort. We also reserve the right to charge the guest for loss of revenue in the event that a room or facility is closed or cannot be sold as a result of accidental or criminal damage.
