St Michaels Health Club terms & conditions

Acceptance of a membership application by St Michaels Health Club constitutes a contract of membership which is subject to adherence to the following Health Club terms and conditions. St Michaels Health Club reserves the right to accept or reject any application for membership without ascribing any reason for doing so, or to cancel any membership should that member's conduct contravenes any of the membership terms and conditions or company policy.

TERMS USED
Monthly membership fees - the fees you pay each month by direct debit for the month ahead and are collected on the 1st each month.
Annual membership fees are fees you pay for the year to come.
Corporate membership fees – paid monthly by direct debit or annually.
Other fees - any fees which are payable in addition to monthly, annual or corporate membership fees.
Guest fee - a charge for your guest to use the facilities.
Members - people who we accept to become member.
Joining fee - A charge that may be required on sign up or re-join to secure your membership place.

CONDITIONS OF MEMBERSHIP
1. Your Membership
1.1 Acceptance of an application for membership by St Michaels Health Club (SMR) will constitute a contract for membership subject to these terms and conditions.
1.2 St Michaels Resort may, at its discretion, terminate your membership without notice if you break company policy.
1.3 The Member will pay the Monthly/Annual Membership Fees or Corporate Membership Fees.
1.4 The Monthly Membership Fees can only be paid by monthly instalments if the Member has entered into a Direct Debit agreement.
1.5 If your direct debit is rejected on two or more occasions, we may terminate your membership. If you want to reinstate your membership subscription having defaulted, you will have to pay the direct debit which were rejected.
1.6 We may refer any missed payments, (for example, payments you owe for the rest of an initial term or notice period), to a collection agency.
1.7 All membership is personal to you and you cannot loan or transfer it to another person.
1.8 A Health Check must be completed by each member before use of the Health Club facilities. Certain medical conditions may require a medical referral and a specific exercise programme before using all facilities.

2. Pricing

2.1 St Michaels Resort reserves the right to increase prices at any point during the term of the membership. St Michaels Resort reserves the right to pass on in full any changes in the prevailing rate of Value Added Tax (V.A.T).

3. Your Membership Wristband

3.1 Upon joining you will receive a membership wrist band; this will be your access control and will link directly with you Membership profile. It will allow you to access the facilities for which you are entitled to use. This wrist band will remain the property of St Michaels Resort and must be returned to the Health Club on termination or suspension of membership.
3.2 You must present your membership wrist band at reception on each visit to access facilities. If you forget/lose your wrist band, we will need to verify photographic identification on our system and access may be denied.
3.3 If you lose your wrist band, we will charge a minimum of £5.00 per replacement band.
3.4 All members will be required to have a photograph taken for security purposes.
3.5 Members must produce their membership wrist band at time of payment in order to receive published member’s discount/benefits, on products and service. Discounts or loyalty benefits will be refused without an active membership wrist band.
3.6 Any misuse of the access control system may result in immediate termination of your membership.

4. Suspending Membership

4.1 Members are entitled to freeze their membership however a full calendar months’ notice will be required in writing.
4.2 Membership will not be suspended retrospectively (for a period which has passed when you did not use the facilities for any reason).

5. Repairing or removing club facilities

5.1 To provide the highest standards of facilities we occasionally will need to carry out repairs and refurbishment. No credit or refund subscriptions will be provided at times when some or all the facilities are closed for repair or refurbishment.

6. Cancellation

6.1 If you want to cancel your membership you must notify St Michaels Resort in writing a full calendar month before your cancellation date. Anything post that date will result in the direct debit being cancelled the following month. It is recommended this be done via email.

7. Children

7.1 Children under 16 must have an adult member present to supervise them in all areas of the facilities at all times.
7.2 Children may only use the facilities during times allowed which are clearly marked and outlined in the company policy.
7.3 Parents and or guardians are responsible for the conduct of their children and must ensure that they adhere to company policies.

8. Disclaimer

8.1 St Michaels Resort will compensate Members for any loss or damage they may suffer if it fails to carry out our obligations under this agreement or to a reasonable standard.
8.2 St Michaels Resort is responsible for any breach of any duties placed on it by law (including if it causes death or personal injury to you by our negligence), unless that failure is due to: • Your own fault (including failing to pay attention to health and safety signs and staff instructions); Another person or company not connected with the services we provide under this agreement; or • Events which neither our suppliers nor we could have expected even if we had taken all reasonable care.
8.3 St Michaels Resort is not insured for any loss, damage or theft of Member's personal property, or that of their Guests, on the premises.
8.4 St Michaels Resort is not responsible for any death, personal injury or illness suffered by a Member, their Guest or Hotel Guest arising from their decision to participate in any form of physical activity.
8.5 St Michaels Resort reserves the right to: - Amend the rules at any time, notifying such change on the member notice board. Individual notice to members will not be required. Change or close of certain facilities temporarily for decorating, cleaning, essential repairs or maintenance of equipment and/or Special events. Refuse to book an appointment if you repeatedly cancel. Show new members and other individuals the facilities of the Health Club and allow them access on a trial basis. Use any photographs of members or guests for promotional purposes. Dispose of any item of lost property unclaimed for a period greater than 1 month.

9. Other

9.1 St Michaels Resort can: change, withdraw or add to these Terms and Conditions and the company policy or change operating hours where deemed necessary.
9.2 Management of the gym and facilities is controlled by St Michaels Resort who require members and guests to comply with any reasonable directions given to ensure the smooth operation.
9.3 St Michaels Resort, whose decision shall be final and binding, shall determine any dispute or difference, which may arise in interpretation of these terms and Conditions and company policy.
9.4 Members bringing guests to the Club must be present at all times
9.5 Inclusions within the Wellness Membership must be utilised per month or sessions will be lost

10. Membership Behaviour Rules

St Michaels Resort has an expectation that Members and their Guests will conduct themselves appropriately and at no time should their behaviour negatively impact on the enjoyment of another user. For more details on our Gym & Poolside Etiquette please see separate sheet which is included in your welcome pack and displayed throughout the facilities. Members and their guests must not:

10.1 Abuse the equipment or facilities of the gym (Members will be responsible for the cost of repair or replacement for any negligent or deliberate damage to gym property).
10.2 Behave in a violent or rude way or in a way which offends, distresses or annoys anyone else.
10.3 Make derogatory or defamatory remarks about St Michaels Resort, its staff or other members or spa users
10.4 Smoke in any part of St Michaels Resort or bring alcoholic drinks, drugs or other mood-altering substances into the Resort grounds, this includes the use of e-cigarettes.
10.5 Use the facilities of the gym while under the influence of alcohol, narcotics or other mood-altering substances.
10.6 St Michaels Resort will not allow photography within the pool area, gym or studios unless express written permission has been given beforehand.

11. Children's Rules

11.1 Use of the thermal rooms is not permitted for anyone under the age of 16 years.
11.2 Treatments are not available to anyone under the age of 16 years unless there is a specific teen treatment/promotion or special event where an appropriate adult must be present at all times.
11.3 Restaurants/Dining - St Michaels Resort have various restaurants, Members should please check the restaurant terms and conditions for Children's reservations and restrictions.
11.4 Children may not sign guests into the Health Club. Management can refuse admission to a Member or their Guest or ask a Member or Guest to leave the facilities if they reasonably believe that they are in breach of any of these company policies
